All investigations are conducted in strict accordance with UK law, including the Data Protection Act 2018, the Regulation of Investigatory Powers Act 2000, and the Human Rights Act 1998.

Our cyber and OSINT work operates exclusively on open-source, passive, and lawfully-obtained information, in accordance with the Computer Misuse Act 1990.

Our commitments

We will not undertake unlawful investigation methods. We will not accept instructions where we believe there is an improper purpose. We are transparent about what investigation can and cannot achieve.

Where the line sits

What we will and will not do

Most of this is set out at length in our legal and regulatory framework and terms of engagement. This is the short version. If you are comparing firms, choosing an investigator lists the questions to put to each of them.

We will

  • Agree the scope, method and cost in writing before any work starts.
  • Tell you at the outset if investigation is unlikely to answer your question, or if a cheaper route exists.
  • Report what we found and where we found it, in a form a solicitor, tribunal or insurer can use.
  • Keep billing, contact and correspondence discreet, on the terms set out in our discretion notes.
  • Point you to free specialist support where that is the right first step.

We will not

  • Obtain information by pretext or impersonation, or access accounts, devices or systems we are not authorised to use.
  • Intercept calls or messages, or track a vehicle or person without a lawful basis.
  • Trace someone who left in fear of the person asking, or where a court order is in place.
  • Accept an instruction where the purpose appears to be stalking, harassment or coercive control.
  • Confirm or deny to anyone else that an investigation exists.

In clients' words

We instructed Harwick to investigate a suspected data exfiltration case involving a former employee. Their cyber investigation team traced the activity and the report was accepted without challenge at the employment tribunal.

Working with Harwick on a difficult family matter was the easiest part of an otherwise impossible situation. They were patient, kept everything completely confidential, and produced exactly the evidence my solicitor needed.

Private individualScotland

An internal investigation into suspected procurement fraud was managed end-to-end by Harwick. The findings were robust enough to support recovery of losses through civil action, and the reporting format was appreciated by our solicitors.
